Electronic Devices and Weapons
My name is Tracy Givens and if you have not already heard of me I am sure you will be hearing my name in the coming months as I push for laws to be enacted restricting the sells, use and possession of electronic devices and weapons that are now available to organized crime, terrorist groups, hate groups and the general public.
I will also be pushing for funding to train local, state and federal law enforcement personal in the detection and prevention of such devices and weapons.
You see I have been made a victim of such devices and with the current laws how they are I can not receive any help. Its not because law enforcement does not want to help, its because they are not trained in the detection or prevention of such equipment, equipment that can injury and even kill with very little psychical evidence, equipment that can disrupt computers and other electronic devices in your home or business and equipment that can be purchased on-line or built in your own home for very little money and with out a degree in electronics. A terrorist or hate groups dream weapon if you will.
As you are all aware handguns are a very serious issue in are society today but most cases involving a crime or killing using a handgun can be traced and solved. That is not the case with electronic devices and weapons due to the limited funding and training our law enforcement officers doing these investigation are given at the present time. This must change; there must be more funding available to these officers for training and equipment so they can keep up to date with the changing times, so they to can be well armed and equipped to fight the ever increasing number of electronic attack complaints across the nation.
I would like all of you to consider passing laws and legislation banning the sell and owner ship as well as very stiff penalties for those caught using such devices and weapons designed to attack, intimidate, damage or harm persons and property alike. For your reference I am including an excerpt from the Michigan Public Acts of 2004 and urge all of you to bring this to the floor for swift change.
Excerpt from Michigan Public Acts 256 of 2004
(k) “Harmful electronic or electromagnetic device” means a device designed to emit or radiate or that, as a result of its design, emits or radiates an electronic or electromagnetic pulse, current, beam, signal, or microwave that is intended to cause harm to others or cause damage to, destroy, or disrupt any electronic or telecommunications system or device, including, but not limited to, a computer, computer network, or computer system.

750.200i Unlawful acts; penalties.
Sec. 200i.
(1) A person shall not manufacture, deliver, possess, transport, place, use, or release any of the following for an unlawful purpose:
(a) A harmful biological substance or a harmful biological device.
(b) A harmful chemical substance or a harmful chemical device.
(c) A harmful radioactive material or a harmful radioactive device.
(d) A harmful electronic or electromagnetic device.
(2) A person who violates subsection (1) is guilty of a crime as follows:
(a) Except as provided in subdivisions (b) to (e), the person is guilty of a felony punishable by imprisonment for not more than 15 years or a fine of not more than $10,000.00, or both.
(b) If the violation directly or indirectly results in property damage, the person is guilty of a felony punishable by imprisonment for not more than 20 years or a fine of not more than $15,000.00, or both.
(c) If the violation directly or indirectly results in personal injury to another individual other than serious impairment of a body function or death, the person is guilty of a felony punishable by imprisonment for not more than 25 years or a fine of not more than $20,000.00, or both.
(d) If the violation directly or indirectly results in serious impairment of a body function to another individual, the person is guilty of a felony punishable by imprisonment for life or any term of years or a fine of not more than $25,000.00, or both.
(e) If the violation directly or indirectly results in the death of another individual, the person is guilty of a felony and shall be punished by imprisonment for life without eligibility for parole and may be fined not more than $40,000.00, or both.
