I'm not sure, but I think that the wallpaper from the skinsfactory is ripped (x-box wallpaper.)

If I recall correctly, Stardock (Wincustomize) has dealt with both MS and Apple with regards to this issue in the past and it seems that they've "resolved" their differences in a suitable manner to appease all parties. I'd be comfortable in saying that whatever appears on Wincusto or Stardock's sites, meets up with mutually agreed upon criteria.
