x-box wallpaper ripped

I'm not sure, but I think that the wallpaper from the skinsfactory is ripped (x-box wallpaper.)

Hi,

I'm not sure if any permissions are granted to you, but on themexp.org you are hosting a x-box wallpaper.
This wallpaper was originally made by: the skins factory, in order for x-box.
I will drop you a line first, befor I will send one to the skins factory, and I've already informet the admins at wincustomize.
If you don't have the permissions, would you please remove the wallpaper, or else I have to send a e-mail to themexp too, and they might considder to remove your account there.

If I'm wrong, and you have their permissions, I appologize.

yep themexp is a disgrace, as i also noticed this visual style from what it appears my wb mud buttons "with slight modification"

Plus its true what Chris said from irc "what I find interesting is that they poo poo wb themes as being complex and prefer "simple" skins. I wonder if this in fact an aesthetic choice on their part or the fact that the majority of skin makers can't make anything sophisticated or imaginative except in the case of rips"

First it was PixOS now X-Box wallpaper what next..

I only wish moderation was brought in for ThemeXP.org as this really annoys me that they pull graphics from others put it in their skins, wallpapers whatever upload it an thousands download it, no respect whatsoever no credit to authors, take take take.

Plus not only that someone else started a thread here saying WinCustomize has not very good wallpapers, browsing thro Themexp and seeing just about every type of wall with microsoft windows xp all over it and britney spears

Why is the Wincustomize community so concerned about ripped images when some of the images on Wincustomize are ripped from commercial products as well? Some examples that can be found are skins designed to look like the classic Mac interface, skins designed to look like OS X, skins designed to look like Windows XP, and variations of the WinXP and OS X interfaces.

Rather than go, yet again into a long-winded dissertation on the pros and cons of porting, fair-use and ripping just suffice it to say that when an original author complains that something is/has been used without permission we will push for its removal, no matter where.
Same goes for Apple and/or Microsoft.

In the case of this subject thread, the X-box skin is a specific commissioned and therefore authorised wall that has been stolen and uploaded elsewhere without permission.
It's called 'theft'.

I have also noticed that Wincustomize also contains tons of wallpaper stamped with the Windows XP logo, Apple logo, and XBOX logo without Microsoft's and Apple's permission.

A few years ago, Apple specifically went after people using their copyrighted logos, etc....they clearly didn't appreciate the cross-pollination between the Computer formats.

The problem with an 'Aqua' 'look' is whether a general similarity can be prohibited, or only those people bent on absolute replication.
With the latter, we require the removal of specific Apple logos and any overt references to the Apple company and product[s].

Microsoft appears to be quite happy to have people skinning their OS and enhancing its use and enjoyment with the use of their 'XP' logos, etc....and probably are quite entertained by the Apple 'styled' works being applied to a PC.....

Wincustomize.com is, however just a bit tired of the flood of XP-related/specific walls, as is the case with every new fad/OS...

The Apple wallpapers, skins, and object bars I have seen do not have the Apple name on them, but most of them has the famous apple with a bite out of it logo.

The more this 'issue' is pushed, the more likely Apple will notice and demand every and ALL remotely related works be removed...if that's your agenda then you'll upset quite a few people.

Apple has a right to control it's intellectual property doesn't it?

I am kind of on the fence about intellectual property rights and such. I feel that people who have put a lot of work into creating music, movie, software, and other products that have no concrete existence deserve to be paid for it. I just think some copyright owners such as record companies really go to far in controlling intellectual property.

I have purchased the premium suites offered by Stardock and Pixtudio and I am very happy with them. I recently purchased the Wincustomize Browser so that I can get the premium suites released only for Wincustomize subscribers and to have a less limited way to access skins and themes from Wincustomize.

I appreciate the high standards set forth for what submitted wallpapers will be posted. I like being able to select from a collection of high quality wallpaper. I wish the same standards could be set for submitted skins and themes. Too many times I have downloaded a skin that looked good in a screenshot and turned out to be crappy when actually on my system.
