Aqua Supreme 1.5

I spent a considerable amount of time creating this DesktopX suite. I even fixed a buggy OSXP winblinds skin that works with my theme. I spent time capturing a screen shot to show it capabilities, zip, upload, describe and comment. And for what? They posted my first version, as soon as I updated it with a fix and new features they simply deleted it. Real good way to shoot down an aspiring skin artist. >

I think someone was jealous, because it gained popularity so quickly, and some untalented bastards out there are pissed off. It really is the best suite going, inspired by Judge's OSXP skin.

they tipically don't delete skins... that's interesting... why don't you re-upload it??? that's wierd that it would get deleted...

im curious to see what it looks like, perhaps they thought it was a rip or something  upload a screenshot to your desktop image so we can check it out

Dunno what the deal is, but *if* you used (or appeared to use?) actual components of another's work without the author's permission that would be a reason for deletion. Or it could be a misunderstanding? Did you receive an email regarding the deletion? Did you email the site admins to ask the reason for the deletion?

Based on what I've seen the admins here do not appear to delete posted skins/themes without sufficient cause. Anyway, the reason for deletion can only effectively be resolved by contacting the admins, if they haven't already contacted you.

moebis, I'd think the first and only real place to seek an answer for your questions and thoughts would be with the admins. Though I probably would do a little editing and rethinking on how to approach someone I was looking for understanding and help from.

just my wackybob pov for what it's worth...

moebis: Your DesktopX theme was exiled because it is made almost entirely of images from other people's work. Although you expressed thanks, you included no permission. Your WindowBlinds skin was not accepted for the same reason. You cannot modify another person's work and upload it without permission, even if you feel you were just fixing bugs.

Hmm, I know this from somewhere. Let's hope the next thing he says will not be "The original themes where all crap and I just fixed the errors."

Dear moebis,

Thank you for your recent upload of your Aqua Supreme for WindowBlinds.
Unfortunately your upload has not met our guidelines and has been rejected.
However we do look forward to your future submissions.

Reason: You cannot upload another author's graphics without permission.

Sincerely,
The WinCustomize Staff

Seems fairly clear to me.
I received this email, so I'm sure you did too.
Misuse of another skinner/artists graphics is not permitted without prior written permission, and that also included with the submission.
Public complaints alleging 'jealousy' etc is pointless.

The only thing that was used from Judge was his background wallpaper. The grass was redrawn to blend better. His theme (which resembled this one) was a ObjectDock theme. I completely redid it for Desktop-X, I didn't even use any of his icons. The real "copying" was the WindowBlind theme, which is just to complement this DesktopX theme. I fixed the sliders which had a obvious repeating tile effect. If you don't want to post the fix for the WB, that's fine, everyone else can just download his OSXP and fix that themselves. The Desktop-X theme "Aqua Supreme" is an origanal work. Judge got the background from somewhere else also. It's just a wallpaper that suites this design. I'm improving this theme on a daily basis, and it WAS built from scratch.

If a skin or wall is derived from another's in ANY way and to any degree....and in this case where the origin was still evident, if it is submitted without consent it is called 'ripping'.
That is polite 'trendy-skin-speak' for 'copyright theft'.
Just accept it.
Either obtain consent[s], or submit something else...

Ok, I got permission from Judge, and I really have to thank him, because it was HIS origanal creativity that inspired Aqua Supreme. Anyways, the new screen shot and Desktop-X theme is posted (just waiting for moderator review). Like I say in the description, I really want to make this the best, cleanest and most funtional theme ever. I could use some true expect skin skills from whoever would like to share in this project. Thanks.

moebis...
Again, ALL persons' works used in your upload must have consent and have that consent included within the skin or theme. ...not a statement 'I got consent', but an email conversation extract..eg...
Dear 'Judge'.....can I use your wall?
cheers, moebis
[date, url, bla bla]

moebis...
sure go ahead....post a link to my stuff...
Judge.
[date, etc etc].

THAT is what is meant by verification of permission.

Remember...Any person's graphics, whether modified or not, big or small.

While you wish to make the 'best theme/skin possible', it will fail to be even approved if it does not encompass the best professional and ethical intentions.

An E-Mail enquiry has been received from the OSXP site with the following information:
From: [email protected]

Subject: ObjectDesktop Wallpaper
Message: Judge, I'm involved in a contraversy with the sysops @ wincustomize. I created a DesktopX theme inspired by your ObjectDock theme. I used the Grass wallpaper on that theme for mine. I gave complete credit to you, since I also use your OSXP theme to compliment this, and I tell everyone to use that WindowBlinds with my DesktopX theme to make it complete. Anyways long story short, I need to get permission from you to use the wallpaper from your theme. Can I please use this wallpaper? -Carl Moebis

The icons used in this theme were rescaled and reframed to fit the animation of the launch bar. They were collected from many different (public domain) icon packs from around the web. As a matter of fact I see several themes on this site which use them in their theme without "said permission" from whoever origanally started floating them around.

I also used an element from Thai Pangsakulyanont desktop-x theme (the bubble clock) but I can't seem to find his email address. Any help there please?
OK...you're 'getting there'....
Now, that email extract needs to be in the upload, the note about publicly sourced free-use-for-redistribution icons be mentioned, and just hunt down this other permission and it'll all be fine.

I know it seems like a lot of work, but in reality, I have two works I've been eager to upload for MONTHS but cannot, as I'm not getting a response from the original author lately.

Frustrating, but I am ham-strung...

ditto... I created a dashboard awhile back and can not get a hold of the original author ( unanswered emails... only 2 but I don't want to be a nuisance) So I removed the material that I was not able to get permission for... I keep that version for meself which is ok by me.

Static....mine is specifically designed to fit in with a specific wall graphics....I cannot remove the 'bits'...there'd be nothing left....
