Windowblinds Upload

I have uploaded two WB skins that seem to be in limbo. They have not been rejected, nor have they been posted. Is there a problem I am not aware of, or am I just being ignored?

Klatuu....there is a suggestion that elements of Universe Metal were used in their creation.

If so, a permission.txt would be needed.

I'll have a closer look myself, for you.

One of the 'problems' associated with a popular skinned proggy is the advent of 'repeated' styles, whether accidental or intentional...and it is unfortunately up to the Admins of this and other sites to try to distinguish exactly what is what and whether some form of clarification/consent/whatever is needed.

I'll delve into it more closely this evening for you....

OK...now 'Dilithium's frametop.bmp is definitely 'derived' from and replicates the style of the Wincustomize.com site skin 'Universemetal' which, I might add, is my site skin of choice....[never use any other].
The 'glassy' text bubble 'may' be a wild coincidence, but not when put alongside the 3 horizontal slots as well.

Clear use of another's graphics which will require artist's consent....in this case, Pixtudio.

I have personally acted on their [Pixtudio] behalf in the past, 'convincing' people to do the 'right thing' when creating derivative works.
In this case I'd say it would be doubtful if consent would be forth-coming as I'm sure a 'Universe Metal' Windowblinds skin is well within the capabilities of the copyright holder/s. [I'm sure you will agree]...

Similarly, 'MidnightOasis' frametop.bmp borrows too heavily from the same origin, although it is recoloured.

I'm afraid I'd have to recommend both not be publicly posted...

One of the 'roles' of an Admin is to help keep an eye on what is and isn't allowed to be redistributed on the Website.
Often it is Copyrighted images erroneously downloaded from a 'Public' Movie site, or similar and re-used under the assumption that a wall made from it is a 'private use'.
And it is.
The problem arises when this wall [or skin, etc] is uploaded for others to subsequently use.
That part of it is 'redistribution' or 'public broadcast' which is definitely beyond the scope of a 'private use condition'.

Some works DO receive specific prior permission, or are even COMMISSIONED by the Copyright holder and are allowed for public redistribution, but this is rarely the case.

Terms of agreement with a company and the Artwork creator can be quite variable, depending on the status of the 'employment and/or contract involved.

Back to basics, however, if a skinner/artist wishes to employ or derive works from another he/she must seek [and obtain] prior permission before uploading, and include a copy of the permission email/whatever received, and preferably also a note that permission was granted and is included.

It isn't hard to do, but it CAN be frustrating if and when permission is not forthcoming or is just 'slow'.


As a matter of interest, one 'contributor' here spat the dummy and wanted his account deleted recently when I rejected his work because he had no permission included or stated.
His response was that IF I had 'bothered' to ask the other guy I would have been told he had given permission.
I said thanks, but no thanks, It is not the responsibility of the Website to go get permissions for people....but the submitter's responsibility to ascertain the legitimacy of the submission PRIOR.

He tootled off to Deviantart instead, but I suspect he may have at least learned something and not just become another nuisance at Devart...
