Is it copyrighted or not?

I have seen lately that alot of people are uploading themes without permission. It's especially bad on DesktopX themes. They will take a bunch of other people's skins and throw them together, than upload it. Sometimes they give credit who made them but no permission. I have been seeing it alot on other sites. (Deviantart, alot). Is it a copyright issue?
Do these people own the package now or what? I personally think it should stop, but I might be wrong. What do you think? (Example, Azul for DesktopX).

dunno anymore what the stance of WC is..I am totally confused when it comes to that. I know that at least you should ask permission to use others work, and it has to be stated in the description area.

IIRC, I think the intent of DesktopX objects is to share them and allow them to be used in other themes (since a DesktopX object is a self-contained resuable object. However, I believe certain criteria must be met.

1. You cannot modify the object without the original createor's permission.
2. You cannot alter the original creators's credits and notes that are in the notes tab of the object.

I don't know if the author has to explicitly say in the notes section that the object can/cannot be used and reposted in other themes.

In the theme you pointed out, it looks like Mormegil's zoomers and blocks. He's always freely allowed them to be used in other themes.

My understanding of DesktopX is that the objects can be freely used by anyone. That's why there are so many themes using other people's objects. I agree with Chris, there should be at least those two rules applied.

The only other place you will see someone upload another artist's work is Winstyles. In that case, you can put together a theme using anyone's skins and wallpaper as long as you use the .suite extension, which does not redistribute the skins.

Hopefully you are not seeing any other use of another artist's material on this site because it's not allowed (without permission). If you do, please point it out to an admin so it can be removed.
