Need permission to use Diamond.wba

I have heavily modded this skin and I don't think it is any longer the same skin. Who or how do ask permission, anyway?

Just to use it yourself or to upload it for others to download. If just for yourself/personal use, you need no permission.

If its for your own use no permission is required.. If you plan to distribute to other people permission will be necessary.. Contact the original author.

1. The skin you have posted at your website on Deviant Art... installs as Diamond WB by Stardock Design.
2. You have at your website also explained how to use the skin as you named it by changing the name.

So you are not only breaking just copyright laws. But are instructing others in the use of doing as you have tried to do.

This skin doesn't install as Diamond WB. you must have been listening to Ms. RadialFX. See screenie, no Diamond directory:

Whether it installs as Diamond or not . . it does use Stardock's art and needs to be removed now until permission to use is granted..

Probably won't happen. It's back to msstyles for me... I get fairly angry looking at Stardock products. Who do I speak with about a refund? I would rather not do a charge back if possible.

I adapted Diamond.wba. I was not engaged in "copyright infringement", rather "fair use" is more descriptive..

It's rather cheeky that anyone on this board (or anyone from this board who simultaneously trolls DA). There are numerous skins here which use MS bitmaps, *.avi and *.png. Right now I am looking at Longhorn5203LogoffDialogButtons.bmp; Longhorn5203ShutdownDialogBackground.bmp; Longhorn5203ShutdownDialogButtons.bmp; and Longhorn5203ShutdownFlag.bmp inside Lemon Vista.wba as an example. The MS flag and orb also very prominent in many shins. IIRC WB 5.5 contained a full-on port of XP Luna visual style.

In the last couple of days I have seen a very offensive "hall monitor" mentality around here (and also from members of this community who troll DA). All of the pettiness, finger pointing, name-calling and righteous indignation amuses me in a sick sort of way...thats why I removed Moissanite XP: I did not want to sink to this level by responding in kind .and by leaving my "Deviation" in place I was being sorely tempted to do so.

No one around here seems to know about discrete PMs. Try common manners some time. They gets results more quickly than does initiating flame wars: honey attracts more than vinegar.

Again, if there is a procedure for a refund for my purchase of WB6 I would like to know.

Your fair use needs to be examined more carefully. See the contents of your creation of the copy of Diamond UIS file in the wb folder for the wb. As seen here...

One more good word to have you think over. Most copyright lawyers never take quick action for the simple reason... they don't make much money that way. Damages are incurred on a daily basis and are charged the same way. No matter if you where warned or not it still happens that way. Ending with a total for when it is either removed by the person responsible or those in authority. Your best interest would be to remove the skin you have posted at Deviant Art and do another skin of your own with whatever prgram you want. [ Personally I don't care if you use some mickey mouse program...]

Wow... You want a refund because you changed a skin and were denied permission to submit it...



The community just is here to help, and is only behaving like a "hall monitor" because the skin had a copyright, and was modified and released without permission. Natural response, and there have been quite a few more cases on the boards.

Please read my above post- the skin in question was removed yesterday, I don't understand what kind of problem this is posing now. Furthermore the above theory about copyright lawyers is rather "out there". No financial losses were incurred by Stardock by my adaptation, and I did not profit from it in any way from the DA posting. It would be impossible for a king of torts to demonstrate the existence of any damages to Stardock.

As far as the copyright notice in the screenshot posted above by SGT , it would appear that permission to import any skin into Skin Studio, open a *.WBA file in WinZip, open a *.UIS file in notepad, open images in MSpaint or any other image editor would be a violation, also unless written permission is given.Even taking a screenshot of a Stardock theme could be considered "reading". In spite of that, Stardock tutorials urge users to to do all this things without informing.readers of legalconsequences:WWW Link. This and the fact that the copyright notice is buried deeply in the *.WBA file, inside a *.UIS file would make it difficult to enforce.

So far no one has seen fit to address the fact that numerous WindowBlinds themes available on Stardock sites make use Microsoft resources and MS and Apple logos. A full-on rip of XP luna was included by Stardock in WB 5.5. Have permissions been granted for any of these? That is rather like the pot calling the cauldron black.
