Who is to say the store knew where it was lost at the time? If you pull a bone headed stunt, are you going to run and tell someone? Perhaps you would, but many would try to hide their stupidity.
Once the deed was discovered, and the finger found, there are enough witnesses to the fact that giving it back to the guy who lost it so that it could be re-attached was the right and decent thing to do. Instead, this clown could only see dollars dancing in front of him.
The finder did nothing legally wrong. He did a lot ethically and morally wrong. And in the end, I hope the Jury considers that when he brings the lawsuit. He was not harmed in any way. The guy who lost the finger has paid for his stupidity with the loss of the digit. The store I am sure has already suffered loss of sales, and if it is found that they did indeed do as you alleged, then they indeed deserve that loss. And if there is a penalty, give it to the customers who patronized the establishment in the past.
