Insight..... the guidelines at this time, regarding Fan Art of this nature, is that it would be acceptable.

Opinion.... I have a LCARS based HoverDesk theme that I made, and use when I'm feeling Trek-ish.  I will never upload it........ because......
1... I don't think the Fan Art/Gray Area is a correct interpretation of copyright laws. Fan Art is for me to make for personal use only, unless I get permission for the copyright holder (period). Nothing gray about it in my mind. 
2... I emailed Paramount's copyright department quite some time ago........... and I'm not at all surprised that I haven't heard from them. 

But remember, that's just my opinion. One I share for the most part, only with myself. 

'Fan Art' as argued as 'fair use' may apply to US Copyright law but apparently does not show as a viable argument in Australian law...where for example fair use does not encompas making 'backup' copies of a Music CD...though it is deemed 'fair and appropriate' to allow backups of 'significant' important media such as OS/System/Program data for crash/loss survivability......something NOT 'critical' when referring to an Audio CD or file....

In an 'ideal world' exactly NOTHING would be allowed to be duplicated/distributed without EXPRESS permission of the copyright holder.

Here at Wincustomize.com we have a tendency to let 'some' things through, though we are mindful of Apple logos [in particular] and when finding the source of some images on a 'home site' with clear statements prohibiting duplication/distribution we are obliged to reject the submission/s.

Other sites commonly accept/allow anything and everything, and in-so-doing we see artists such as ourselves being 'ripped' with total lack of regard for anyone's rights at all.

Final determination of what can, or cannot be uploaded lies with a community's determination of what is 'right' and what is 'wrong'.

Ideally any 'Fan Art' should be entirely home-made and not sourced from copyrighted images belonging to another person or entity.  In practise we get a 'grey' area which is unfortunate, but which many seem to want.
