Rip Report....

Rip Report....

This website http://www.macoszone.com has ripped my walls without my permission. I have sent them a cease and desist e-mail. I suggest other authors check to see if they have been ripped too.
Judging by the extract from their terms of use page below, they claim to understand copyright laws. I think they need to take another look at the laws!

And Winboost is distributing Iconpackager 2.0. I don't know if it's the shareware or registered version.
Hum, seems Winboost has two of mine, Gold'NSilver and NightVision cursors, but the zip is named starone2 and starone3. No contact for permission.
happend the same to me starone, named:
styl skinner1 and stil skinner2
It is the shareware version of Icon Packager but that does not make it ok... redistribution requires permission.

Sometimes I just get really pissed-off with people.

Well, there are going to have to be some changes as to who can download what, this has become an epidemic that shows no signs of slowing down. >

Jafo, has Winboost been contacted?
The CZ one bounced the email.

i cant seem to get onto the site to actually have a peek, not like anyone would rip my work

but how can you decide on who gets to download what?

its very true that it is in no way fair on the authors of who's work is being ripped but banning Joe Public from certain downloads will have a drastic affect on the site will it not?

OK...Re MacOS Zone...

Latest response from its owner...

I deleted Boxxi Brian Cook’s art. Tell me others and I’ll do the same

That is a start.
Now, everyone concerned, or with specific contacts with others who are or may be, now is the time to respond here.

In particular, considering the number of works, MobiusCo....do they have permission from you? [I'll email direct]

Edited to remove email links as requested, since site owner is responding appropriately.

Subject: Use of authors materials on website

Your response to my use of images on my website has been noted. However unless the artwork is yours you can not hold me liable for using someone else’s artwork. I have tried in the past to make every effort to contact such authors and either have gotten favorable response or have not gotten any response. Our legal team has found no violations in the way we handle unknown authors features on our site. If you have any further statements to make please direct them to me in writing.

Mark...
Might I suggest you employ a more capable legal team?
Firstly, Posting ANYTHING by author 'unknown' is a clear indication that NO permission was granted to you for displaying/distributing their works or images.
That is a clear and open admission of copyright violation.
This thread at Wincustomize.com is in part a verification of your failing/s.
Link
In particular, BoXXi [Bryan Cook], a fellow Administrator of Wincustomize.com states he gave no permission to you to host/display his wall images.
That yet again is a clear verification of copyright theft.
The author of a work retains full rights to its use and public distribution unless otherwise agreed.
I have been a Professional working in the graphics industry for 30 years. I know and understand International copyright law.
I suggest you do likewise.

Be aware that each and every work on Wincustomize.com is and has been uploaded/submitted there by its author and thus remains within that author's copyright control.
This is clearly not the policy at macoszone.com .

Unless you and your site treats graphic artists and their inherent rights with the appropriate respect you will be ostracised from that community...either by reputation and/or by ISP instruction.

Yours, sincerely

Mr Jafo sure can write those letters. It's the passion, me thinks.

slinky...no, it's just a respect and enjoyment of our little skinning cosmos...someone 'needs' to help as and when they can...
So far, BoXXi's works have been removed, as has those 'unknown' works by 'unknown' author/s.
I'm getting there....slowly...

Thanks Paul, you are a star! If I wanted my works on sites like that I would post them there, and as my work these days is usually exclusive to this site, I hate it when others take it and offer it for download at sites that I would not personally be involved with.

If that is the one featuring Janetino's fractal wall... it was the first link in Boxxi's thread...
they do not have written pemission from her even though they did post her name as author.
It is still an unauthorized ripoff...

btw: is senior member from deviantART something special, or just like you've been around for long? I mean, is it like a admin/wizop ?

Styl...a 'Senior Member' at Devart tended to be [originally], people who had been around a long time in the skinning scene even prior to the genesis of Devart...but you'd have to ask Jark for more clarification...
[In my case I think it was more a subtle dig at my age]
