Copyright Infringement Again

http://my.desktopnexus.com/larisa/

There is a youg lady over at Desktop Nexus that is displaying my work, Devjit, I E braniac ,Shaffy, Jazzilady, Redneck Dude, Firebrick, just to name the ones I recognized. I am being told that I need to file a claim on each wall in order to get them removed. In my case that is over 40 claims. Can this be correct? Why can't the offending person just be told to remove all copyrighted work from her gallery? Looking for a little help here. I did join the site so I could leave a post on her profile asking her to remove my work.:S

See link in header.

Check for your work.

It says in one of her comments from someone that she had passed away on March 6th...

I did not bother to read her comments and if she has passed, I am sorry but non the less the copyrighted material is still being dispalyed on Desktop Nexus and they should remove it no matter what the circumstances.

Quite frankly it's a shame she didn't 'pass away' BEFORE stealing people's IP.

I'd give her a fond send off if that was the case.

As it stands circumstances will just make IP protection more of a pain in the bum than it usually is.

Use that form letter [of Koop's] to give the site a push to resolve things....;)

I am still being told that I need to fill out a form for each Wall in question and submit it individually. Is this kosher? It's a real pain to have to track down each wall here and cross reference it there, especially with all the bugs on the site at the moment.

Just clicked the link and yes one of my wallpapers is there under Recently Uploaded Wallpapers. It was uploaded 31st January, 9 days after it appeared on WC.

Not sure what u expect anyone can do about it, If it is your work, and it's bothering you that much then submit the forms for each violation, find a cheap lawyer or say bugger it and succumb to the fact that the Internet is a pretty shitty place and people in general do pretty shitty things whilst hiding behind it. There are quite a few submissions on this site as well with no permissions, links to vague and non-specific linked web resources.

Whats good for the goose I suppose.

Hey I.R, you got one comment on your 'Spring Pastels' wall X-(

Well well - how do we pay bills when no interest is made due to low volume website? We take a no body and get them to do wrong to increase things for more volume..!

I think I would send a email to [email protected] the owner and whatever for the sight in general... http://www.harrymaugans.com/ then address the fact of all these rips present on his website.

But who knows how long it may get delayed. Even if the proper people got involved these types of people are ruthless at doing what they please to the full extent of any laws. But there are ways for everything...

Trying to paste his response

Hi Frances,

We do not want to violate any copyrights.  The quickest way to get
them removed is to visit each wallpaper, and click the "Report This
Wallpaper" tab under the preview.  From here there is a DMCA Copyright
Violation link, which will guide you through the removal process.

Best regards,
- Harry

The young lady referred to by Frankief is not the only person on this site uploading WC members' work. Go to this site's homepage and enter your WC nick in the search box to see who else is posting your work.

I had 5 works at this site but I have seen works from people here on other artists site. Relhorn, vStyler, Vervi39(Vito), Frankie, to name a few. Kenwas I think you have a couple also. I suppose on some level if we permit downloads you have to expect it. It's not going to stop me really. :jafo: :ninja:

I am in the process of PMing a comprehensive list of all the stuff from WC that I have found while trying to resolve my own issues. Check you messages to see if you are on the long list. I am sending the same list to all in order to expedite this endeavor but you can easily see your title followed with the urls.:meow:

I have just got an email from them , here is what they said

Hi shaunna stevens,

We would like to inform you that we have reviewed your DMCA claim request on DesktopNexus.com and were able to validate the supporting details you included.

The wallpaper you've reported (Wallpaper ID #277704) has been deleted from our servers, effective immediately. Additionally, we have saved a unique, alphanumeric 'thumbprint' of the original image, and added it to our internal DMCA blacklist. If any member ever attempts to reupload that same wallpaper, our system will automatically detect it and block the upload, citing copyright violation as a reason. If you have any additional questions, feel free to reply to this email.

We apologize for any inconvenience this has caused.

Regards,

Shaunna....looks like they are just caught up in the 'deception' as the real artists were/are.

It's why all approaches to having works removed be as civil as possible...as the guilty party is nearly always a 'third' one ...;)
