Skin issues

Here it is in a nutshell;

My tittlebar should look like so

However, when it isn't idle and I am browing or I bring the window on top it turns in to this

Any advice/pointers are really appreciated thanks.

This is a repost unforunately since I have yet to solve the problem.

Unfortunately it's a problem recurring specifically with skins made my a certain publisher. This skin and most of the other published skins by this person ( http://amaeli.deviantart.com/ if interested ) were made for XP and not vista. With most skins made for xp/wb5 don't seem to have this problem.
